Abstract

The expansion of Fixed Recoverable Costs in October 2023 marked one of the most significant recent reforms to civil litigation in England and Wales, with the aim of promoting proportionality, predictability, and access to justice. However, over two years on, practitioners continue to struggle with the FRC regime and the often-unexpected implications it can have on litigation strategy. In this talk, Scott Cowley and Amie Boothman of Exchange Chambers explore the tactical considerations of FRC from pre-issue through to trial, as well as common pitfalls, recent judicial guidance, Part 36, the hidden costs of interlocutory applications, and situations in which litigants may be able to escape fixed costs altogether.
