On Tuesday the 10th February 2026 the LBPCF was pleased to host Mr Justice Henshaw (pictured above) at the University of Liverpool’s School of Law and Social Justice. Mr Justice Henshaw delivered a fascinating paper on retention of title clauses (ROT) and sale of goods contracts.
Mr Justice Henshaw’s paper was entitled: “Bunkers and Buffets: Claims for the Price of Goods” and a full draft is available under the speeches section of this website.
Mr Justice Henshaw discussed a recurrent theme in sale of goods/commodities cases, namely, whether the seller is entitled to sue for the price, as opposed having a mere damages claim. He began his talk with the 2012/13 litigation against John Holt & Co (Liverpool) Ltd, and ended his talk by considering two conflicting decisions of the Commercial Court decided within the last twelve months. Mr Justice Henshaw also touched on the work of the Liverpool-based International Cotton Association.
This event was chaired by HHJ Cadwallader (pictured below) of the Liverpool Business and Property Court. After the talk Mr Justice Henshaw took questions from the audience which was made up of local practitioners (barristers and solicitors), local judges including HHJ Pearce, and students and members of the public.
